Being a Landlord in the US

US laws and practices typically favor the rights of tenants over those of landlords.  In general, rents are freely negotiated with the exception of Rent Control ordinances in some large communities of California, Washington D.D., New Jersey, and New York.

State requirements vary in terms of security deposits, contracts, and eviction procedures.  City and local councils can also pass their own regulations, as long as tehy are not more lenient than federal and state legislation.  In general, reports that:

  • Georgia has no restrictions on security deposits, they typically are equivalent to one or two months rent.  Deposits should be maintained in a separate account, and any unused deposit must be returned to the tenant.
  • There are two main tenancy agreements: a lease (fixed term, rent, and provisions) and a rental agreement (short timeframe, automatic renewal, provisions can change with advance notice).
  • Rent is usually paid monthly, in advance.
